The Truth About The Gated and Guarded Housing Development In Taman Mutiara Puchong.......



Today I decided to go for my haircut and usually whenever I do I make sure that I have a copy of the Star or the Straits Times, but today it was the Star. The usual routine while my hair stylist does her thing is for me to be absolutely engross in reading all of the news in the paper.
Not many articles in there were of particular interest except for 2 articles in PAGE SBW 24 & 25 (Land and Property-Starbiz Week 18th April'09).

I have always wanted to post something about the G & G concept especially concerning such a "concept" promised and promoted by Malton for Taman Mutiara Puchong housing enclave.

Not many residents truly understands the definition of such a concept or terminology and the pitfalls of some of these "concept" by developers, especially those who seek to "enhance" their marketing strategy in promoting such a development to the masse of potential house buyers in Malaysia. It is a known fact that due to the alarming rise in crime rate YOY (year-on-year) with the police citing lack of man power amongst many reasons including the escalation of foreign work force and etc for the cause of the increase, it is no wonder the G & G concept of housing is in great demand and is evident more today in most residential development projects.

What I would like to share is that when I first bought a house in Taman Mutiara Puchong, I made the most common mistake of actually believing everything I heard from the marketing or sales people that were in the showroom and on top of that I was guilty of the cardinal sin of not checking thoroughly the specifics of the housing development by actually poking around more e.g. (land title, building plans, read the DMC properly).

I was guilty of actually equating Malton's reputation with their previous developments in various parts of Klang Valley with the development I was buying into and taking things for granted that if they could build other places well it will most likely be the same in Taman Mutiara Puchong and the last thing they intend to do is to hoodwink the buyers.

I was one of the hoodwinked individuals of many but since then I have learnt and is the reason to share. I am not implying it is entirely Malton's fault for trying to make their property or the said housing development have more appeal, and more attractive to home buyers looking for housing projects offering a G & G concept but some research is necessary to avoid any complications, would be my first and most important advice.

Not many residents in Taman Mutiara Puchong knows about the "actual" facts in regards to the G & G "concept", these facts are known by only a handful of resident owners whom have been active as members of the residents association since late 2006 - early 2007.

After you have read both the articles you will conclude that TMP is not a truly gazetted G & G because of the following facts:
1. It is not a strata land title but instead individual land title for home owners.
2. Original building plans was without perimeter fencing, perimeter fencing was only erected after additional building application submitted and approved by MPSJ. This is also the reason for the initial design of the perimeter wall without the said bard-wire at the top to prevent intruders.
3. Point No.1 and No.2 is why Taman Mutiara Puchong is without a club house and swimming pool.
4. No Joint Management Committee is necessary as TMP is not a stratafied land development category (not under COB) hence note the exception in the DMC where it specifically stipulates that the vendor of the land (Malton/Interpile Sdn Bhd) has the right to appoint or relinquish management of the property to the Residents Association or any licensed property management company appointed by the Residents Association if it decided to do so.
5. Specific mention in the DMC for vendor or appointed vendor to collect service fees (including maintenance) of a specific sum and change in the said sum from time to time at the sole discretion of the RA by way of tabling new amount to be voted in the respective AGM by a majority of home owners present as and when it is necessary.
6. Specific mention to the management of the said property in regards to defaulters and the specific rights of the property management company/vendor to take the necessary steps to ensure stable and sufficient collection from property owners.

In TMP's case the DMC is the rule of law together with the house rules. Due to this unique setup the RA has the authority to also pass any by-laws if it is needed and to be voted accordingly in the EGM or AGM by members of the RA which consists of residents themselves (as resident property owners with vested interest in the community and representing the community it is important to note that this set up have the advantage of achieving very specific objectives for the betterment of all in the community - especially when dealing with the developers or the local council or any other external parties).

The only reason why the RA in TMP is in charge of the management is because of the following facts:
1. Last minute notification to the RA that Interpile Sdn Bhd will relinquishe the responsibility of providing management services in Taman Mutiara Puchong. RA previously responded to Interpile to continue with the management @ RM 80.00 service fee per month as Interpile have confidently issued notice to all households of the said fee being RM 80.00 from the original amount of RM 50.00. (At the time only 397 units of houses were sold with less actually occupied.
2. RA of TMP with just less than 20 members at the time had no choice but to sacfrifice time and pooling resources to organise the very first AGM 2008. Members all contributed by sponsoring in cash and in kind to get the said AGM organised all out of their own pockets.
3. RA of TMP carefully calculated and projected a service fee amount of RM 100.00 in response to be better prepared and managed accordingly with the said amount not to increase over the next 5 - 8 years. Calculation of the amount factored in the number of units not sold (more than 100 units in 2008, including bumiputera lots) out of the total 504 units. This is necessary to potray a more accurate projection of monthly service fee collection.
4. Within 2 weeks the RA of TMP had to invite property management vendors (more than 6 quotations evaluated) and selected base on price and reputation of service provider.
5. Subsequently after take over from Interpile Sdn Bhd officially the RA of TMP pursued many objectives and implemented and enhanced the community and over the course of 12 months much improvements were made as chronicled in this blog.

Although much have been done, it is far from over as much more remains especially the main tiresome and repetitive issue of "HANDOVER". Currently you will be able to notice the drainage in TMP being attended to with sacks of sand being pumped out of the main sumps all over. This is part of the requirement by MPSJ for Interpile to address after the RA submitted a host of issues officially through the appropriate channel.

This process is painstakingly slow as is evident and is the only cause of delaying the intended construction of the second entry lane into TMP. Previously this was the cause of the delay and the response of MPSJ not being able to erect the road humps requested by the RA, but since then (more than 1 year waiting) the RA of TMP decided to move ahead and fund the said contruction of the road humps anyway as the dangers of the speeding vehicles and the main concern for the safety of the children in TMP far outweighs any legal implications.

I can go on and on about what has been done and what else is needed or pending but my main objective here is to share and for all residents to be informed that the RA is doing what is needed and need the full support of all the residents to ensure more solidarity and sustainability. A special message goes out to all the defaulters to wake up and be a team player in this community. Your property lies in the boundary of TMP community hence with more funding more can be done to enhance and improve facilities and environment. In the end the value of the said property will benefit and hence the owners will benefit. This is the foresight that all of us stakeholders must have to ensure that we are above average but yet affordable.

Erosion at Puchong pond getting worse

Worse than before: The erosion has almost reached the chain link fence around the pond.

THE soil erosion at the lake edge near Taman Mutiara Puchong has become worse and the residents want action taken immediately.

The problem was highlighted in StarMetro on July 17 last year but nothing has been done to tackle the problem.

“Now, after six months of consistent downpour, the soil has eroded further into the lake. Large crevasses have appeared up to the perimeter fencing,” resident Gerard Lim said.

He is worried that the problem may worsen in the coming months.

“The residents hope that the developer and the Subang Jaya Municipal Council (MPSJ) can respond positively with a permanent measure to rectify the problem and not wait for a bigger problem to happen,” he said.

The developer, when contacted in November, said the land at the side of the pond does not belong to them.

“The chain link fence represents the demarcation line between Mutiara Puchong and the other people’s land.

“We have surrendered the lake edge area (which was landscaped earlier) to the local council. Hence, it does not belong to us and neither does the pond.

“Since the land belongs to another party, technically, we cannot be held responsible for erosion control on their land,” it said in a statement.

However, the developer was keen to address the problem by constructing a couple of sumps at the affected area.

“Whenever it rains, the water will find a natural course to flow. In this particular case, the rain happened to flow from the landscaped area into the pond. Over time, this had created the erosion of the lake edge.

“We can collect the water into a sump and then channel the water through pipes directly into the pond. This will prevent the rainwater from causing further scouring of the slopes of the pond,” the developer’s statement said.

MPSJ councillor Chang Kim Loong told StarMetro recently that he was aware of the issue.

“I have submitted an official letter to the council to highlight the erosion problem, as well as the incident two months ago where fish in the lake died suddenly.

“Some said the fish died because of discharge from a nearby factory, while some said it was due to the change in the water temperature.

“The MPSJ will carry out investigation on these matters.

“I will drop by the MPSJ today to see what can be done to solve these problems,” he said.

A RESIDENTS FEEDBACK

Thank you once again for highlighting the issue of soil erosion at the lake edge of Taman Mutiara Puchong in StarMetro on Tuesday 6th January 2009.

It is nonsensical for the developer Malton to claim that the land at the edge of the pond does not belong to them when the developer themselves had dumped many truck loads of earth into the lake to prevent further structural cracking of the corner houses / units which till today left several unsold! I have photo evidence showing the original land area when we moved into our home in 2007 and the present extended land area of 50'ft further into the lake.
By the developer simply putting up the chain link perimeter fencing is not suffice to say that it is the demarcation line between Mutiara Puchong and the land of others! Strangely indeed, how does a developer surrender only the lake edge to the local council MPSJ when the entire Taman Mutiara Puchong has yet to be surrendered to the local council? Yet, residents of Taman Mutiara Puchong have for the past two years been paying the local council MPSJ "Cukai Taksiran"..Assessment Tax.

Obviously, the developer is "washing their hands" of this matter by pushing the responsibility to the local council MPSJ. I sincerely hope that the local council MPSJ would be quick-witted in handling this matter and not be coerced into accepting otherwise.

Thanks for highlighting the issue in the media in your StarMetro 6.1.09 issue titled ' Erosion at Puchong pond getting worse'.

The impending issues were deliberated in the Jawatankuasa One Stop Centre (OSC) MPSJ this (8.1.09) afternoon.
The Director of Enginering Dpt. En Adnan Derahman has yesterday (7.1.09) visited the site and is finalising his report to the committee.

The Director of OSC, En Norjafni has forthwith been directed to initiate a meeting to be chaired by Timbalan YDP inviting all the related developers; namely Malton, YTL, Glomac and Interpile as well as all the neighbouring RAs namely, Persatuan Penduduk Tmn Mutiara Puchong, protem committee Lake Edge and Lakeview to attend the discussion and to sort out the imminent problems in no uncertain terms.

As soon as a date and time is fixed, all are invited to attend and be heard. I shall notify you in due course and shall be at the meeting with Cr Ng Sze Han.

Dear Cr Chang & Xin Yi,

Thank you for highlighting and bring up the soil erosion issue to the press and the relevant authorities to act before a catastrophe occurs; otherwise the Developer would be very famous for the wrong reason, and the owners of the affected houses (should the houses collapse into the eroded lake edge) would have their properties "gone with the water" and the whole Taman house value "gone down the drain".

From a layman's view, the cause was that there was no sheet piling done at the lake edge. The last soil collapse reached the last corner house whose entire garden and fence disappeared, which prompted the Developer's immediate action to re-fill hundreds of lorry loads of soil to maintain the lake edge to its present distance from the lake, as confirmed by Gerard's statement.

Rain water supposedly flows into drain holes at road curbs drags with them sand and mud, clogging the holes. Heavy downpour has been causing flood in this stretch next to the lake caused by the clogged holes. Flood water over flows to the lake edge and that's how the soil has been eroded so fast. The Residents' Association has proposed to the Developer rep to install pipes connecting rain water at the curb edge directly into the lake, but was turned a deaf ear probably due to cost factor and the common "contractually not obligated" statement. Instead, the Developer has dug a trench within and along the perimeter fencing and channel the collected rain water out to the same eroded spot, which is not a solution. In fact it would accelerate the soil erosion even faster.

Mutiara Puchong experienced not less than 6 times serious flooding. One of the causes was most of the sumps in front of each adjoining house was clogged by sand which impeded water flow to the monsoon drain just outside the entrance of the Taman. Rain water has to flow into holes at the road curb through underground drains to the bigger drain at the north near the TNB high tension area. This is an ex-tin-mine land and the amount of sand being flushed into the holes is massive. MPSJ has to maintain a routine schedule to clear the sump to avoid flooding recurrence.

Taman Mutiara Puchong RA look forward to the meeting with MPSJ, the 3 Developers and RA Committees, and we will bring along photos to support our findings and hope to find a solution to the erosion problem before a calamity happens.

House Buyer Dilemma in TMP (Phase 3)


This is an email I received today which is of a concern to all house buyers in Malaysia, something we should be aware of and be prepared in the future when dealing with any developer to ask the right questions to ensure that your rights as a house buyer is not easily trampled on and taken for granted and that you have all bases covered before signing any SPA.

Please read and if you know of more such home owners in Taman Mutiara Puchong facing the same predicament then please forward your email to mytmpcommittee@gmail.com as it is logical for these home buyers to get together and get the right representation to allow their grouses be heard by the proper authority that can assist in resolving this thorny issue.

EMAIL EXTRACT OF A VERY CONCERNED HOME BUYER IN TAMAN MUTIARA PUCHONG

Just to bring up an issue regarding my current difficult situation of purchasing the TMP unit. 6 months ago, I sign my SPA in the show room office and yet till now I still not getting my key to renovate my house. When I check with the developer (Interpile), they told me that it is because land office holding the consent of transfer. When I ask them what is the reason where land office holds the approval, they told me they have no idea.

Due to the frustration I personally go to land office to find out the issue, the officer told me that it is because that Interpile does not fulfil the land office requirement – Building Low Cost Houses and this was told to Interpile few months ago. Later when I call Interpile regarding this matter, they told me that they knew this issue and already settle (don’t know how they settle). I also find out that there are about 20 units same situation as me (some have sign SPA more than 9 months ago)

Now I get caught in the middle whereby one end hold the approval and the another end told me the issue has settle. Recently Interpile try to pursue me to change loan financier so that the money can disburse to them without the approval of the consent. I told them I have no problem to change my banker as long as on their end can guarantee the approval of the consent within 1 or 2 years. But at the end they told me they cannot promise me anything, they can only release the key for me to renovate and stay upon banker release the disbursement but no guarantee on the consent approval (which mean money disburse to them but legally the house still not belong to me).

I believe some of the existing resident or owner of TMP house face the same problem (money disburse to developer but till now the title still not charge to owner or banker). Therefore I would like to use your blog to gather some of these owners (who may concern on their title or charge of property) to discuss further.

By the way, I also one of your frequent reader for Voice of TMP.

Lake now the pride of Puchong folk

IT WAS once an eyesore but the lake near Taman Mutiara Puchong has now become a landmark that the residents can be proud of. A year ago, StarMetro highlighted the sorry state of the lake, which was polluted by construction debris and rubbish.
Fish in the lake died and the stench reached the residential areas nearby, making the residents both worried and angry.

“We bought the houses because we believed that there will be a beautiful lake in the area, as illustrated in the brochures,” said resident Gerard Lim, who brought up the matter last year.
The Subang Jaya Municipal Council (MPSJ) had taken action against the developers for illegal dumping and the fine was used to clean up the lake.
The developer of Taman Mutiara Puchong has also landscaped the edge of the lake with perimeter fencing, benches, shrubs, lawns and a proper walkway of about 300m.
There is also a platform for the residents to view the scenery.
Lim said the residents were pleased with the current state of the lake.
“On a sunny day, the sunset here is very beautiful,” he said, gesturing at the shimmer of sunlight on the lake.


Neat: The lake has 300m-long walkway with benches and plants lining the sides.

During StarMetro's visit to the lake recently, birds could also be seen gliding on the water surface in search of fish.
However, Lim pointed out that soil had eroded at certain spots of the lake's edge.
“Land reclamation was done previously on the lake, but the foundation was clearly not strong enough,” he said.
The residents association is hoping that MPSJ could put rocks or plant suitable trees along the lake to hold the soil together to prevent further erosion.


In need of attention: Soil erosion at certain parts of the lake edge at Taman Mutiara Puchong.

“The area is dark at night so we hope streetlights can be installed, too,” Lim said.
He added that there were still some irresponsible contractors who would climb over the barrier to throw debris into the lake.
“The residents association has to be alert to prevent these cases from happening,” he said.
MPSJ president Datuk Adnan Md Ikshan said the council would first determine whether the said problems should be tackled by the developer. “If not, we will look into the matter,” he said.

Dr.Dog Examination and Selection Campaign

This was the first time ever that the Dr.Dog examination and selection program managed by Furry Friends Farm and sanctioned by Animals Asia Foundation was jointly organised with a residents association's involvement in Malaysia. The program was a huge success as there were more than 10 candidates participated along with their handlers and friends as well as some observers whom attended to find out more about the said campaign.
Such a program has already been proven to be a tremendous success in Hong Kong and China and it is with this knowledge that FFF and TMP RA is working hand in hand to bring this program to the next level in Selangor and ultimately throughout Malaysia. It is with great enthusiasm that TMP RA is very proud to be a part of such a humanitarian program and thus will continue to be involved in promoting the Dr.Dog program within Selangor by providing FFF with a venue to conduct all future Dr.Dog examination sessions.

Residents association from around the area are also encouraged to start such an initiative as the benefit derived from enabling volunteers from various communities to partake in this program will create the necessary resources and education to all pet owners of the benefits of the Dr.Dog program and its objectives.
Future undertaking will also involve the organizing of World Animals Day scheduled on the 4th October 2008 and it will be held in TMP Central Park. Although it is still some time away, TMP RA is proud to show its committment to support such a great program for the community in TMP (with 50+ owners with pets) and at the same time assist FFF (Furry Friends Farm) to achieve its objective of creating animal welfare related objectives and community enriching program such as Dr.Dog.

Residents take initiative to plant trees

RESIDENTS in Taman Mutiara Puchong (TMP) took the initiative to plant trees in their neighbourhood to help in the government's greening effort after each family were urged to adopt a tree and grow them in their front yards and other suitable locations in their residential areas.

The go-green campaign, a joint effort between TMP and the Subang Jaya Muncipal Council (MPSJ) was launched by state senior executive councillor for Industry, Investment and Trade Teresa Kok and MPSJ president Datuk Adnan Md Ikhsan.



“For sustainable development, everyone should do their part to keep the earth green. It does not matter what species of trees or plants as long as we make an effort to keep our area green,'' said Teresa.

“As parents we have a responsibility to teach our children to respect the environment, as it is not an easy task to explain the concept of global warming to young children if there are no trees.

“How are our children to know the importance of trees if they are not taught at an early age,'' she said.



Meanwhile, Adnan said MPSJ was all for the campaign and that community leaders could work with the council in the greening effort.

Since the TMP is fairly a new residential area, there were not many families which took part in the campaign but all those who were present made some concerted effort to adopt a tree.

The families tend to their respective adopted tree until they mature.

Flooding In TMP 6 between Phase 1 and 3

Above pictures showing the junction road between TMP 6 Phase 1 and Phase 3 flooding with water rising approximately up to 4 inches and at some places especially the backlane of TMP higher due to uneven gradient. Such flooding is common and I believe in this blog we have posted pictures and videoclips of previous floods during Raya October'07 and a couple other occasions. The RA have submitted many complaints before previously to the then adun of Kinrara Dr.Kow Cheong Wei and also to MPSJ. The developer has also been informed of this on numerous occasions. Though the flood water receeded quickly this time around it is still not acceptable that the said water level can still rise and that the drain sump can still backflow and be filled to the brim during heavy downpour. This is unusual amd abnormal to say the least. To all residents please forward your complaints individually as I believe residents in Phase 3A are also concerned and it is to my knowledge that the road right in front of the guardhouse will also be flooded during heavy downpour, unfortunately I do not have photos (need someone to send to me) to show of these other places affected by flooding within the same TMP compound. Please forward your complaints via online to MPSJ in their online complaint portal called "RESPONZ". Please sign in as a member and state clearly your complaints providing nature of complaints and location of the said complaint. Clearly provide your contact details for MPSJ to verify. If you are able to provide photograph evidence and post online and link in to your complaint then it will be better, only if you can do so.

More Residents Speaking Up!

Dear RA,

Having seen what happened last Saturday, I am very disappointed. The worst is this may just be the begining of bigger problem, when flood water gets into the house! I just want to bring a few points of this issue. The problem may not just be the internal drainage system within the TMP compound. I believe the internal drainage can cater for that sort of rain. I believe the real problem is stormwater can't "get out" of our compound due to the full capacity of the main drain in front of our entrance. When there is heavy downpour, I observe that the main drain will be near its full capacity (but not overflow yet).
Therefore, apart from our "beloved" developer, we still need to get MPSJ / JPS (depends on who is maintaning the main drain) to be involved to resolve this. Potential solution is to find another drainage discharge outlet (apart from the main drain; I can see the "lake" only). However, this will involve a lot of $$ to re-design and re-do the drainage gradient; possibly at Phase 3B. Another root cause is the design platform of TMP is not "high" enough. Useless to talk about it because there is nothing we can do about it now. Obviously, substantial amount of $$ saved on earthwork.

Another sickening sight is our guardhouse and entrance. Frequent beakdown of boom gate, dodgy CCTV (working or not working, I don't know), road barrier (why is it there? this is still a construction site? to stop motorbike????), insufficient road lighting, fast car / motorbike from industrial area, heavy lorry moving in/out from our entrance (dropping earth, dirty & damage the road) etc.
For the boom gate, I think the motor is under-powered. It can't support a long boom. When I visit One Utama, I noticed that their car park boom is the type when it lifts up, it will form an "L" shape (the mid section will fold and held by a tie back to the motor). I guess this will lessen the stress on the motor and less breakdown.

The guardhouse is the "face" of TMP. With the current deteriorating state, I believe our house value will drop. Floor tiles fallen off, dirty, potholes at the entrance etc need to be adressed.

I faced similar issues when I lived in an apartment by a shit developer called T****, and I can understand why it happens. I thought things will get much better when I moved here but doesn't seem worth the $$ paid for.

I hope the RA (with the backing of all residents) can bring all these issues up with the developer, authorities and MP/DUN. Thanks.
